Detective speaks out in Wienckowski case

 
The truth is slowly beginning to come to the surface in the case of Amanda Wienckowski. Wienckowski is the young woman whose remains were found inside a stolen garbage tote off of Clinton St.in 2009. In a Buffalo News article today, a recently retired detective raised some troubling questions about how the case was handled by the Erie County Medical Examiners. Mark Lauber admits that he and his fellow investigators never agreed with the County labeling Amanda's cause of death as a drug overdose.

“We realized right away the cause of death was not from a lethal amount of opiates for someone who used heroin every day,” Lauber said.

“So we called the medical examiner’s toxicologist, and he agreed with us but said they could not find another cause of death and went ahead and listed it as an accidental drug overdose,” Lauber said.
The detectives didn’t believe there was enough heroin in her system to cause an overdose.

The Examiners did not have a definitive cause of death, but they did know  she didn't have enough drugs in her system for it to be a drug overdose. Yet, they listed her death as a drug overdose? This makes no sense at all. A second pathologist reportedly felt the cause of death should have been "undetermined." Why they chose to call her death a drug overdoes is what people want to know.

Buffalo detectives want the public to know they did everything correctly on their end. They believe Amanda died accidentally during rough sex with Antoine Garner (the last person known to have seen her alive). Garner is behind bars for strangling a prostitute a few months back in an abandoned house. Luckily, she lived to testify against him. 

The public knows who caused Amanda's death. It's just a matter of time before justice catches up with him.

Amanda Wienckowski's life was cut way too short at the hands of a gutless coward. Because of corruption and incompetence in city hall, her death has never been ruled a homicide. This, despite the fact that her frozen body was discovered in a garbage tote across the street from the last person who saw her. (A man with a history of violent crimes against women.)

Amanda's family has never made excuses for the choices she made in life. Fighting a long battle with addiction, she put herself in some difficult situations. However, she did not deserve to die the way she did, and her family deserves answers.

Leslie Brill, Amanda's courageous mother, will be holding a rally this Saturday December 12th at noon in front of City Hall. Empty Suit Brown won't be there, as he only shows up to feel good events, like parades and Street Namings. I believe the authorities underestimated Ms. brill's resolve. Her friends and family will not let Amanda be forgotten and are demanding justice. I also will never let this story die and encourage the public to join them this Saturday at noon to continue this fight. 

Wienckowski case on WBEN Saturday at noon

WBEN will be discussing the Amanda Wienckowski case tomorrow (Saturday) at noon. Her family has been searching for justice since Amanda's body was discovered in a garbage tote on Clinton and Spring Streets.

I plan on following this story until the authorities tell the public how her body ended up there. This has never been explained. How is dumping someone's body not a crime? Why would someone try to hide her body if they themselves were innocent of any wrongdoing? Lots of questions remain. God bless Amanda's mother and her family for fighting for her. Wienckowski case to be topic on WBEN

I received this email from someone close to the Amanda Wienckowski case. They will be discussing it tomorrow at noon on WBEN...

On 1/7/12 (tomorrow) Please tune to AM radio 930 at (12:00 noon). Kathy Weppner will be discussing Amanda Wienckowski’s death and how Erie County’s ME’s Office was allowed to review their own absurd autopsy findings.

I wonder how many Cops would rob banks if they were allowed to investigate the robbery?

The original Autopsy was conducted on (elected) Dr. Anthony Billittier’s watch and signed by ...four of his appointed employees. This Autopsy failed to note the latter found evidence of strangulation, genital trauma, GHB (date rape drug) and blunt force injuries that Amanda sustained. All were commented upon in Dr. Silvia Comparini’s report that is viewable on Artvoice in PDF format.

Even an inept moron would label her death at least SUSPICIOUS.

Thank you Buffalo for your support and generosity to achieve justice in this Matter. You see the way our elected leaders want to do their jobs and spend OUR tax money.

If the person responsible for Amanda's death is reading this, I think you should come clean. If you committed the crime, you need to own up to it. Being in jail would be no worse than the life you are living now. Just my opinion. It is never too late to turn your life around. ..

Coverup in Wienckowski case continues

Despite her naked, frozen body being found in a garbage tote, Erie County officials are sticking to their claim that Amanda Wienckowski died of a drug overdose.

The victim's family paid for a second autopsy, which had significantly different findings.

The second autopsy, conducted by West Coast pathologist Dr. Silvia O. Comparini, found Wienckowski was beaten, raped and strangled.

Oh, by the way, the last person seen with Wienckowski has been accused of violently assaulting two other women in the past. Sounds like the Erie County officials are trying to cover up for their own incompetence. Just think about this quote from Wienckowski's mother, Leslie Brill...

“My last question is if the girl found frozen and naked and beaten had been a council-man’s [or] congressman’s daughter, do you think there would have been a search, an investigation and an arrest made?” Brill said.

“The Constitution states that all men are created equal, and we should all be equally protected by it. That has not been my experience.”

Truer words were never spoken. As I've stated before, Erie County officials have underestimated Brill's resolve. She will not let her daughter's death go unpunished.

Waiting for justice

I said a long time ago while following this story: The mother of Amanda Wienckowski is not going to let her daughter's death be forgotten. The girl might have made some poor choices in her life, but that is no excuse for the way she died. Her body was found upside down in a garbage tote and her death was ruled an accidental drug overdose. The obvious question is how did her body end up there? Thankfully, local businessman/troublemaker Carl Paladino has taken up the cause for justice in this case. Here is a letter from Paladino to the Erie County Health Commissioner. The person who was last seen with Amanda was arrested twice for violently assaulting women (once before and once after Amanda's death.) The letter is a little long but worth reading...

Dear Dr. Billittier and Dr. Vertes:

The horror suffered by Amanda and her family demands justice. The autopsy of independent pathologist Dr. Sylvia O. Comparini, M.D. and the events since January 9, 2009 clearly illustrate that two crimes have been committed.

The first was the murder of Amanda, the investigation of which was suspended by BPD Homicide immediately after her death because Dr. Vertes incredibly declared the death "accidental."

The second crime is the arrogant, unjustified and despicable attempt by the Erie County Health Department and the Medical Examiner’s Offices to cover up an obviously incompetent, careless and unprofessional, if not fraudulent, autopsy by Dr. Vertes.

The death certificate was signed by four medical examiners. Someone will tell a Grand Jury why. The City of Buffalo assigned two attorneys to fight the release of any information and in concert with the County Attorney vehemently denied the family's FOIL request for information. Would David Rodriquez, Esq. so obstruct without the instruction of his mayor? Why did our public servants waste taxpayer funds obstructing instead of doing the right thing? These are some of the questions everyone is asking.

By copies of this letter, I request that:

1. The Erie County District Attorney convene a Grand Jury to investigate both the homicide and the subsequent activities of you and your offices.
2. The Hon. Gerald Whalen, JSC. immediately compel you and your offices to recuse yourselves from deliberations on the request to change the cause of death from "accidental" to "homicide." All records and evidence in the matter should be turned over to a competent and objective medical examiner appointed by the court to expeditiously determine whether or not to change the cause of death to "homicide."
3. The New York State Office of Professional Medical Conduct investigate your actions in this matter and properly discipline you.
4. The US Attorney investigate the blatant denial of Amanda's civil rights.

After spending months denying Dr. Comparini evidence critical to her work, Dr. Vertes is now seeking "additional information" from Dr. Comparini in what appears to be a further effort to obstruct the homicide investigation and make the cold evidence colder.

Dr. Vertes is seriously conflicted and should not be allowed to rule on the competency of her own autopsy. Dr. Billittier appears to sanction the obstruction of justice and has not shown any disposition to be fair and objective. Both should be fired by the County Executive for gross negligence, if not criminality.

Enclosed is a copy of the Forensic Summary and Dr. Comparini’s cover memorandum. She states ". . .as you know much of what we demanded has still not been produced. Nevertheless, the evidence was more than sufficient--in fact, it was overwhelming--to support my conclusions to a high degree of scientific certainty."

For no apparent reason your offices have attempted to delay, obstruct and frustrate Dr. Comparini's effort. It took almost two years to cajole, pry and grovel a sufficient amount of evidence to get an independent opinion. You fought it all the way. Why?

We do not pay you to deny justice to a challenged family. You are not gods. You are public servants charged with the responsibility to serve all the people and never let what occurred in Amanda's case happen. You failed miserably. Amanda could have been the child of any of us. Would attitudes have been different had she been the child of a BPD Homicide detective?

Over the objection of the County Attorney, who was acting on your behalf, the family was compelled to get a Court order to obtain evidence necessary for the pathologist to professionally execute her forensic autopsy. You obstructed the Court order to furnish specific slides. Body parts and the presence of foreign DNA were "withheld."

You demanded restrictions on the pathologist creating an "extraordinary inconvenience" on her to complete her work.

One would think that public servants, upon discovery of the frozen, naked body of a 20- year-old female upside-down in a garbage tote, would go the extra mile to determine with absolute certainty the cause of death. You violated Pathology 101 by announcing the cause of death before the body even thawed. Was it all about covering up a botched and incompetent autopsy?

Amanda's case is not the first instance of irrational conclusions by the Medical Examiner’s office. The Girard, Aszkler and Kirshner autopsies all bordered on the absurd. Aszkler had two stab and ten puncture wounds, two of which were defined as deadly and nevertheless the Medical Examiner declared the death to be suicide. How does one stab and puncture himself twelve times?

Shame on you Dr. Billittier for protecting incompetence or criminality.

Wienckowski's family searches for justice

This case is very disturbing. The Buffalo detectives claim Amanda Wienckowski died from an accidental drug overdose. The family understandably disagrees. They say they have statements from several people around the victim that night that the detectives aren't interested in hearing from.(???):

Cohen, the family and former Buffalo cold case Detective Dennis Delano have long contended Wienckowski was murdered and dumped where she was found. They said they have statements from a dozen individuals who can shed light on her death, including the names of three individuals who were with her when she was last seen alive Dec. 7, 2008.
Among them, they said, is a man with a history of strangling women during sex. They say police have not expressed interest in that information. Police say the investigation remains open.

Even if she did die from a drug overdose, who threw her naked body in a garbage tote? How is that not corpse abuse? Obviously, this individual has something to hide ( murder perhaps). Did the detectives really think the family was going to accept this ridiculous finding? Who's in charge over there at police headquarters that lets this shoddy investigative work take place? Do you think this case would have been handled differently had it been one of their daughters killed? Their findings clearly don't add up and someone needs to be arrested and taken off of the streets.

Delano believes Wienckowski was murder victim

Add former Buffalo detective Dennis Delano to the list of people who believe 20 year old Amanda Wienckowski was murdered and did not die from a drug overdose. In this story on channel 2, even a layperson can see the marks on her neck that certainly seem to point to strangulation. I would guess that the murderer was one of the last three people to talk to her on the phone before her death. And how did her body get into the garbage tote? Who is the person that dumped her there? Wouldn't a normal person call an ambulance or 911 if somebody overdosed in their house? Wienckowski's mother will not quit until she gets the justice she deserves.

Many unresolved questions surround Wienckowski case

A national expert hired by the family of Amanda Wienckowski has uncovered evidence that points to strangulation as the cause of her death, not a drug overdose. This case didn't pass the smell test from the very beginning. Wienckowski was the 20 year old Lewiston women found dead in a garbage tote with her hair cut off on the East side of Buffalo.

Dr. Sylvia Comparini, a west coast pathologist, has discovered pre mortem pressure marks around her neck consistent with strangulation. However, she cannot rule on a cause of death until the Erie County Medical Examiner turns over her hyoid bone, thyroid, and heart.

Also strange is the fact that the Erie County Medical autopsy was signed by four medical examiners. Normally, these reports are signed by one examiner. Comparini also notes that part of Wienckowski's tongue was bitten off before her death. With all the advances in technology, a competent forensic specialist should be able to trace the bite marks or DNA to one individual. I've seen it a million times on Forensic Files. I'm not accusing anybody of a coverup. Wienckowski's lifestyle obviously contributed to her untimely death. However, she did not walk into a garbage tote on her own after her death. Police need to find out who placed her there. This story will not be going away soon.

Her lawyer says one of the men who last saw Wienckowski has a history of strangling women. We are innocent until proven guilty in this country but not on this blog. To me, this guy's past makes him the prime suspect. Stories like this also make me long for a return to the days of the angry mob...
