Motel clerk arrested despite not breaking any law

I thought this was a strange quote from yesterday's Buffalo News. Niagara Falls police arrested a front desk clerk at a local motel for renting to a 12 year old. Then, in the same breath, he admitted there was no law broken...

“There is no law against renting to a 12-year-old, but [Montanari] knew they were underage and were there for the purpose to celebrate,” DeMarco said.

The clerk was rightly fired for violating company policy, however, I was unaware people could be arrested when no laws were broken. When police start going into the minds of suspects and not using law, we've gotten one step further from Democracy.
